1. Introduction
1.1. These Terms of Use (hereinafter referred to as the “Agreement”) govern the relationship between Rose & Boujee (hereinafter referred to as the “Seller”, “Company”, “we”) and any visitor or customer (hereinafter referred to as the “Visitor”, “Buyer”, “you”) of the website roseandboujee.com (hereinafter referred to as the “Website”).
1.2. This Agreement constitutes a public offer in accordance with the legislation of the Republic of Kazakhstan and replaces all prior agreements, negotiations, or understandings related to the purchase of goods through the Website.
1.3. By placing and paying for an order on the Website, the Buyer confirms that they have read, understood, and fully accepted the terms of this Agreement. If the Visitor does not agree with these Terms, they must refrain from placing an order on the Website.
1.4. The Seller reserves the right to amend this Agreement at any time. Any changes become effective upon publication on the Website and apply only to orders placed after such publication.
2. Status of the Online Store
2.1. The online store roseandboujee.com is owned and operated by Rose & Boujee and is intended for the remote sale of goods via the Internet.
2.2. The Seller reserves the right, at its sole discretion, to suspend or terminate sales, limit access to the purchase of goods, or refuse to fulfill orders if:
  • incorrect, incomplete, or misleading contact information is provided;
  • the Buyer has a history of unpaid or cancelled orders;
  • communication from the Buyer is abusive, inappropriate, or unacceptable.
2.3. The Seller has the right to modify, update, remove, or add information about products, prices, availability, and website sections at any time without prior notice.
2.4. Browsing the Website and viewing product information does not require registration or the conclusion of a separate agreement.
2.5. Access to the Website and use of its functionality for browsing and placing orders is provided free of charge.
2.6. All transactions conducted through the Website are governed by this public offer. Payment for an order constitutes acceptance of this Agreement and results in the conclusion of a purchase and sale contract between the Seller and the Buyer.
2.7. All information published on the Website is publicly available unless otherwise stated.
2.8. The Seller is not responsible for the accuracy of information provided by the Buyer when placing an order.
3. Buyer Status
3.1. The Buyer may be an individual or a legal entity who independently places an order on the Website under the terms of this public offer.
3.2. Payment for an order confirms acceptance of this Agreement and grants the Visitor the status of a Buyer.
3.3. The Buyer is solely responsible for the accuracy, legality, and completeness of the information provided during order placement, including delivery details.
4. Order Placement, Payment, and Fulfillment
4.1. To place an order, the Buyer provides personal information including but not limited to:
  • full name,
  • email address,
  • phone number,
  • delivery address.
4.2. The Buyer’s intent to purchase is expressed by completing the order form and making payment for the selected goods.
4.3. The Seller does not edit or alter the information provided by the Buyer.
4.4. Payment methods, delivery terms, order processing times, and other essential conditions are specified on the relevant pages of the Website and form an integral part of this Agreement.
4.5. Payment is processed via acquiring services provided by Halyk Bank. The Seller does not store or have access to full payment card details.
5. Limitation of Liability
5.1. The Seller’s total liability to the Buyer for any claim arising out of or related to this Agreement shall be limited to the amount actually paid by the Buyer for the purchased goods.
5.2. The Seller, its partners, suppliers, and service providers shall not be liable for any indirect, incidental, special, or consequential damages.
5.3. Under no circumstances shall the Seller bear financial liability exceeding the total amount received from the Buyer for the relevant order.
6. Intellectual Property
6.1. All content on the Website, including but not limited to images, texts, designs, logos, trademarks, and other materials, is protected by intellectual property laws.
6.2. Any copying, reproduction, distribution, publication, or use of Website content, in whole or in part, without prior written consent of the Seller is strictly prohibited.
7. Governing Law and Other Provisions
7.1. This Agreement shall be governed by and interpreted in accordance with the laws of the Republic of Kazakhstan.
7.2. Any claims or objections related to purchases made on the Website must be submitted by the Buyer within 14 (fourteen) calendar days from the date of purchase.
7.3. If any provision of this Agreement is deemed invalid or unenforceable, such provision shall be interpreted in a manner consistent with applicable law, while the remaining provisions shall remain in full force and effect.
7.4. In case of any conflict between this Agreement and other information published on the Website, this Agreement shall prevail.
8. Acceptance of Terms
By placing an order on roseandboujee.com, the Visitor confirms that they have read, understood, and accepted the terms of this Agreement in full.

1. Общие положения
1.1. Настоящие Условия использования (далее — «Оферта», «Соглашение») регулируют отношения между Rose & Boujee (далее — «Продавец», «Компания», «мы») и любым посетителем или покупателем сайта roseandboujee.com (далее — «Сайт», «Покупатель», «Вы»).
1.2. Настоящий документ является публичной офертой в соответствии с законодательством Республики Казахстан и заменяет все ранее достигнутые договорённости, переговоры или соглашения, касающиеся покупки товаров через Сайт.
1.3. Оформляя и оплачивая заказ на Сайте, Покупатель подтверждает, что ознакомился, понял и полностью принял условия настоящей Оферты. Если Пользователь не согласен с условиями, он обязан воздержаться от оформления заказа.
1.4. Продавец вправе в любое время вносить изменения в настоящее Соглашение. Изменения вступают в силу с момента их публикации на Сайте и распространяются на заказы, оформленные после публикации.
2. Статус интернет-магазина
2.1. Интернет-магазин roseandboujee.com принадлежит Rose & Boujee и предназначен для дистанционной продажи товаров через сеть Интернет.
2.2. Продавец вправе по своему усмотрению приостановить или прекратить продажи, ограничить доступ к оформлению заказов либо отказать в их исполнении в случае, если:
  • указаны некорректные, неполные или недостоверные контактные данные;
  • у Покупателя имеется история неоплаченных или отменённых заказов;
  • коммуникация со стороны Покупателя носит оскорбительный или недопустимый характер.
2.3. Продавец вправе в любое время без предварительного уведомления изменять информацию о товарах, ценах, наличии, а также структуру и содержание Сайта.
2.4. Просмотр Сайта и ознакомление с информацией о товарах не требует регистрации и не влечёт заключения отдельного договора.
2.5. Доступ к Сайту и использование его функционала для просмотра и оформления заказов предоставляются бесплатно.
2.6. Все сделки, совершаемые через Сайт, регулируются настоящей публичной офертой. Оплата заказа считается акцептом Оферты и означает заключение договора купли-продажи между Продавцом и Покупателем.
2.7. Информация, размещённая на Сайте, является общедоступной, если прямо не указано иное.
2.8. Продавец не несёт ответственности за достоверность сведений, предоставленных Покупателем при оформлении заказа.
3. Статус Покупателя
3.1. Покупателем может быть физическое или юридическое лицо, самостоятельно оформившее заказ на условиях настоящей Оферты.
3.2. Оплата заказа подтверждает принятие условий Оферты и присвоение Пользователю статуса Покупателя.
3.3. Покупатель несёт ответственность за полноту, достоверность и законность предоставляемых данных, включая сведения для доставки.
4. Оформление заказа, оплата и исполнение
4.1. Для оформления заказа Покупатель предоставляет персональные данные, включая, но не ограничиваясь:
  • ФИО;
  • адрес электронной почты;
  • номер телефона;
  • адрес доставки.
4.2. Намерение приобрести товар подтверждается заполнением формы заказа и его оплатой.
4.3. Продавец не редактирует и не изменяет информацию, предоставленную Покупателем.
4.4. Способы оплаты, условия доставки, сроки обработки заказа и иные существенные условия размещаются на соответствующих страницах Сайта и являются неотъемлемой частью настоящей Оферты.
4.5. Оплата производится через систему эквайринга Halyk Bank. Продавец не хранит и не имеет доступа к полным данным банковских карт.
5. Ограничение ответственности
5.1. Общая ответственность Продавца по любым требованиям Покупателя ограничивается суммой, фактически оплаченной за соответствующий товар.
5.2. Продавец, его партнёры, поставщики и подрядчики не несут ответственности за косвенные, случайные, специальные или последующие убытки.
5.3. Ни при каких обстоятельствах финансовая ответственность Продавца не может превышать сумму, полученную от Покупателя по конкретному заказу.
6. Интеллектуальная собственность
6.1. Все материалы, размещённые на Сайте (включая изображения, тексты, дизайн, логотипы, товарные знаки и иные элементы), охраняются законодательством об интеллектуальной собственности.
6.2. Любое копирование, воспроизведение, распространение или использование материалов Сайта полностью или частично без письменного согласия Продавца запрещено.
7. Применимое право и иные положения
7.1. Настоящее Соглашение регулируется законодательством Республики Казахстан.
7.2. Претензии по качеству товара или иные обращения, связанные с покупкой, должны быть направлены Покупателем в течение 14 (четырнадцати) календарных дней с момента получения товара, если иное не предусмотрено законодательством.
7.3. Если какое-либо положение настоящего Соглашения признаётся недействительным, остальные положения сохраняют свою силу.
7.4. В случае противоречий между настоящей Офертой и иной информацией, размещённой на Сайте, приоритет имеет текст настоящей Оферты.
8. Акцепт условий
Оформляя заказ на сайте roseandboujee.com, Пользователь подтверждает, что полностью ознакомился с условиями настоящей Оферты, понимает их и принимает без каких-либо оговорок.
